١. أطراف الاتفاقية ونطاقها

تُبرَم هذه الاتفاقية بين لازورد (مشغّل منصّة سنّك — "المشغّل") وعيادة الأسنان المشترِكة ("العيادة") التي يقبلها مالكها أو من يخوّله. تحكم هذه الاتفاقية اشتراك العيادة في المنصّة وتشغيل حسابها، وتُكمِّل شروط الاستخدام وسياسة الخصوصية المنشورتين — وفي حال أي تعارض بشأن بيانات المرضى، تَغلِب سياسة الخصوصية.

٢. الخدمة والمقاعد

توفّر المنصّة للعيادة: مساحة عمل سريرية لطاقمها، بوابة مريض، موقعًا إلكترونيًا عامًا قابلًا للتحرير، ونظام حجوزات. يحدّد مستوى الاشتراك عدد مقاعد الطاقم المتاحة (أطباء واستقبال)؛ ومالك العيادة هو من يمنح المقاعد ويسحبها، ويبقى مسؤولًا عن كون كل مقعد بيد شخص مخوَّل.

٣. ملكية البيانات وقابلية النقل

كل ما تُدخله العيادة في المنصّة — سجلّات المرضى، الصور، المحادثات، محتوى موقعها — ملك للعيادة وحدها. توفّر المنصّة تصديرًا ذاتيًا كاملًا كأرشيف واحد قابل للنقل في أي وقت، واستيرادًا لاحقًا له، دون رسوم إضافية ودون احتجاز للبيانات.

٤. التزامات المشغّل

• عزل كامل بين العيادات مفروض على مستوى قاعدة البيانات نفسها، لا في الواجهة فقط.
• تخزين الصور والملفّات في مخزن خاص لا يُتاح عبر روابط عامة، مع وصول موقَّع قصير الصلاحية.
• تشفير الاتصالات أثناء النقل، وعدم شحن أي مفتاح سرّي في تطبيق المتصفّح.
• وصول دعم فني واحد مسمّى ومدقَّق (سجلّ تدقيق دائم وختم "نيابة عن") لا يمكن منحه لحساب آخر.
• إشعار العيادة دون تأخير غير مبرَّر عند اكتشاف حادث أمني يمسّ بياناتها.

٥. التزامات العيادة

• امتلاك الأساس القانوني وموافقة المريض أو وليّه — حيث يقتضي القانون — لتسجيل بيانات المرضى.
• دقّة المحتوى السريري ومحتوى موقعها العام، والالتزام بقواعد الإعلان المهني المعمول بها.
• إدارة مقاعد طاقمها وسحبها فور انتهاء صلاحية أي عضو.
• عدم استخدام المنصّة لأي غرض مخالف للقانون أو خارج نطاق إدارة عيادة أسنان.

٦. الرسوم

الفوترة غير مفعَّلة حاليًا — لا تُحصَّل أي رسوم بصرف النظر عن أي خطة ظاهرة في المنتج. عند تفعيلها، يُشعَر مالك العيادة مسبقًا وتُحدَّث هذه الاتفاقية قبل أي تحصيل، مع إتاحة التصدير والانسحاب دون عائق.

٧. التعليق والإنهاء والخروج

يجوز للمشغّل تعليق وصول عيادة عند مخالفة جوهرية لهذه الاتفاقية أو لحماية أمان المنصّة، مع إشعار مالكها حيث أمكن. يمكن للعيادة إنهاء اشتراكها في أي وقت بعد تصدير بياناتها. بعد الإنهاء، تُعامَل بيانات العيادة وفق مدد الاحتفاظ في سياسة الخصوصية (البند ١١) — تعطيل فوري للوصول، إزالة بيانات الدخول خلال ٣٠ يومًا، واحتفاظ مقيَّد قانونيًا بالسجلّات السريرية ثم إزالتها.

٨. حدود المسؤولية

تسري أحكام إخلاء المسؤولية وتحديدها الواردة في شروط الاستخدام (البند ١١) على هذه الاتفاقية: المنصّة أداة توثيق وجدولة؛ القرارات السريرية كلها للعيادة وأطبائها المرخَّصين، وتقتصر مسؤولية المشغّل عن أي خلل على الرسوم المدفوعة في الفترة السابقة (صفر حاليًا).

٩. القانون الحاكم

تخضع هذه الاتفاقية لقوانين جمهورية العراق وتُفسَّر وفقها، وتختصّ المحاكم العراقية المختصّة بأي نزاع ينشأ عنها.

١٠. التعديلات والتواصل

تُنشَر أي نسخة مُحدَّثة على هذه الصفحة برقم نسخة وتاريخ جديدين، ويُطلَب قبولها عند أول استخدام تالٍ إذا كان التعديل جوهريًا. التواصل: نموذج التواصل على sennak.com.

1. Parties & scope

This agreement is between Lazward (operator of the Sennak platform — "the operator") and the subscribing dental clinic ("the clinic"), accepted by its owner or an authorized delegate. It governs the clinic’s subscription and the operation of its account, and complements the published Terms of Use and Privacy Policy — where patient data is concerned, the Privacy Policy prevails in any conflict.

2. The service & seats

The platform provides the clinic a clinical staff workspace, a patient portal, an editable public website, and a booking system. The subscription tier determines the number of available staff seats (dentists and reception); the clinic’s owner grants and revokes seats and remains responsible for every seat being held by an authorized person.

3. Data ownership & portability

Everything the clinic enters into the platform — patient records, media, chats, its website content — belongs to the clinic alone. The platform provides full self-service export as a single portable archive at any time, and later re-import, at no extra charge and with no data lock-in.

4. Operator commitments

• Per-clinic isolation enforced at the database layer itself, not merely in the interface.
• Photos and files kept in private storage with no public links — short-lived signed access only.
• Traffic encrypted in transit; no secret key ever shipped in the browser app.
• A single, named, audited support identity (permanent audit trail + "on behalf of" stamping) that cannot be granted to any other account.
• Notifying the clinic without undue delay if a security incident affecting its data is discovered.

5. Clinic commitments

• Having the lawful basis — and patient/guardian consent where the law requires it — to record patient data.
• Accuracy of its clinical content and of its public-website content, and compliance with applicable professional-advertising rules.
• Managing its staff seats and revoking them promptly when a member leaves.
• Not using the platform for any unlawful purpose or outside the scope of running a dental clinic.

6. Fees

Billing is currently dormant — nothing is charged regardless of any plan shown in the product. If billing is activated, the clinic owner will be notified in advance and this agreement updated before any charge, with export and withdrawal available without obstruction.

7. Suspension, termination & exit

The operator may suspend a clinic’s access for a material breach of this agreement or to protect platform security, notifying the owner where possible. The clinic may end its subscription at any time after exporting its data. After termination, the clinic’s data follows the retention periods in the Privacy Policy (§11): immediate access deactivation, login/identity data removed within 30 days, and legally-bounded retention of clinical records before purging.

8. Liability

The disclaimer and limitation of liability in the Terms of Use (§11) apply to this agreement: the platform is a record-keeping and scheduling tool; all clinical decisions belong to the clinic and its licensed professionals, and the operator’s liability for any platform issue is limited to the fees paid in the preceding period (currently zero).

9. Governing law

This agreement is governed by and interpreted under the laws of the Republic of Iraq, and the competent Iraqi courts have jurisdiction over any dispute arising from it.
